This policy only applies to various hardware, firmware, software, websites, applications, lawn mowing related machines and services provided by Shenzhen Kaiqi Technology Co., Ltd. and its affiliates ("RoboUP", "we"). (Each item is referred to as a "Product" or "Service", and collectively known as the "RoboUP Products and Services”).

RoboUP understands the importance of personal information to you and will do its best to protect the safety and reliability of your personal information. We are committed to maintaining your trust in us and abide by the following principles to protect your personal information: the principle of legality, fairness and transparency, the principle of clear purpose, the principle of minimum necessity, the principle of accuracy, the principle of storage limitation, the principle of ensuring security, and the consistency of rights and responsibilities principle, the principle of choice of consent, the principle of subject participation, etc. At the same time, RoboUP promises that we will take corresponding security protection measures to protect your personal information in accordance with the mature security standards of the industry.

Information We Collect from You


We may collect information about you directly from you, from third parties, and automatically through your use of RoboUP products and services. Some of the information we collect from you is referred to in this policy as "personal information" or "personal data". Contact information. When you place an order with RoboUP, register for notifications or updates, or contact us for customer service, you may provide us with your contact information, including your name, alias, email address, shipping address, billing address, and phone number. 

Some jurisdictions require contact information in connection with activating lawn mower system products, opening an online account, or other similar circumstances required by law. RoboUP collects and stores information related to lawn mower supervision only to the extent required by applicable law.

Payment Information. When you place an order with RoboUP or conduct a financial transaction using RoboUP products and services, you may provide us with your payment information, such as your bank account, credit card number, or debit card number.

Photos and videos. RoboUP will not automatically collect your photos or videos without your consent and authorized action. When you choose to use RoboUP products and services to upload your photos, videos, or other content (including text content related thereto), such as mowing lawn grass, etc., we may collect and store such content, including photos and videos, or video related EXIF data. If such content contains information about others, you should obtain any necessary or appropriate consent from such persons before uploading such content to RoboUP and inform them of this Policy.

Communication. When you contact us, we may collect information about your communication with us, including your contact information and the timing, subject matter, and content of the communication.

Location information. When you activate a RoboUP hardware product, use our App's map feature, sync your mowing records, get mower safety/regulatory notifications, share your content on Garden Life, or search for nearby mowing spots, you may Provide us with geolocation information. In order to provide your location, you may need to enable certain features of your device (such as GPS, Wi-Fi, and Bluetooth) to identify your location in a variety of ways, including GPS location, IP address, cell tower location, or via Physical on-site Wi-Fi or Bluetooth sensors for detection. If your location is collected through Wi-Fi or Bluetooth sensors on your mobile device or other non-RoboUP products, please note that such sensors and related data services may be provided by third parties and may be accessed by third parties for the following purposes. Equipment related and lawn mowing related information. When you activate a RoboUP product, request after-sales service, unlock geofencing functionality, or upgrade firmware, you may provide us with information about your RoboUP device, including model and serial numbers. Our after-sales team may request your mowing data to provide the service you have requested.

Technical Information. When you visit our web pages or use our mobile applications, you may provide us with technical information about the device that is running your browser or application. This information includes your IP address or device address, web browser and/or device type, the web pages, or websites you visited before or after using the products or services, hardware version and operating system. We may also use these technologies to collect information about your interactions with RoboUP emails, such as whether you opened, clicked, or forwarded a message.

Employment related information. When you apply for a RoboUP position, you may provide us with your educational information, such as your education and school of graduation, and employment-related information, such as your previous employers and work achievements. We may also collect this information from third-party recruiters or websites.

Data. We use cookies and other similar technologies (such as pixels, etc.) on the RoboUP website and online services. Cookies are used to collect information about you, including personal data. We work with third-party service providers to provide us with payment facilitation, package shipping, application development, traffic monitoring or analysis, electronic messaging, and other services. In accordance with local laws and regulations, such as remote identification or other security regulations and requirements, your device-related information, product location and RTK base station location may be transmitted to and received by individuals, companies or organizations as determined by security regulations. RoboUP's qualified resellers are authorized to sell RoboUP receivers only to government agencies involved in public safety, security or law enforcement, security researchers, or owners and operators of critical facilities such as airports, power plants and prisons.

We may retain and disclose your information if required to do so by law or in the good faith belief that such action is necessary to comply with applicable law, respond to a court order, judicial or other governmental subpoena, search warrant or enforceable request. This information may include all the categories described in "Information We Collect" above.

We also reserve the right to preserve and disclose your information when we, in good faith, believe that such information is appropriate to (i) take precautions for liability purposes, (ii) protect ourselves or others from fraudulent, abusive or unlawful use or activity or as necessary, (iii) to investigate and defend ourselves against any third party claims or allegations, (iv) to protect the safety or integrity of RoboUP Products and Services and any facilities or equipment used to provide RoboUP Products and Services, or (v) protect our property or other legal rights (including without limitation enforcing our agreements), or the rights, property or safety of others. This information may include all of the categories described in "Information We Collect" above.

Information about our users, including information you provide and any information collected through RoboUP products and services, may be disclosed, or otherwise communicated to an acquirer as part of any merger, acquisition, debt financing, asset sale or sale, successor, or assignee. In the event of a similar transaction, or in the event of insolvency, bankruptcy or receivership, information will be transferred to one or more third parties as one of our business assets. This information may include all the categories described in "Information We Collect" above.

We may provide certain aggregated, de-identified or non-identifying information about users of RoboUP products and services to third parties for various purposes, including (i) complying with various reporting obligations; (ii) for business purposes or marketing purposes; (iii) product safety analysis; (iv) assist such parties in understanding our users’ interests, habits and use of certain programs, content, services, advertising, promotions and/or features of RoboUP products and services model.

 

Your Rights and Choices Regarding Collected Information


In accordance with relevant laws, regulations, standards, and common practices in other countries and regions, we guarantee that you can exercise the following rights with respect to your personal information:

(1) Access your personal information

You have the right to access your personal information, except for exceptions provided by laws and regulations. If you wish to exercise your right to access your data, you can do so yourself.

We will respond to your access request within 5 days.

(2) Correct your personal information

When you discover an error in the personal information we process about you, you have the right to ask us to make corrections. You can apply for correction through the methods listed in "(1) Access to your personal information".

We will respond to your correction request within 5 days.

(3) Delete your personal information

You can make a request to us to delete personal information under the following circumstances:

2. If we collect and use your personal information without your consent;

3. If our processing of personal information violates our agreement with you;

4. If you no longer use our products or services, or you cancel your account;

5. If we no longer provide you with products or services.

When you delete information from our services, we may not delete the corresponding information in the backup system immediately, but we will delete the information when the backup is updated.

However, please note that using RoboUP products and service features requires some basic personal information to be completed. If you exercise your right to delete, or you refuse to share certain information with us, or you withdraw your consent for us to process information about you, we may not be able to provide you with portions of the RoboUP products and services or any features and functionality.

(4) Change the scope of your authorization and consent

Some basic personal information is required to complete the use of RoboUP products and service features. You can give or withdraw your consent at any time for the collection and use of additional personal information.

When you withdraw your consent, we will no longer process the corresponding personal information. However, your decision to withdraw your consent will not affect the previous processing of personal information based on your authorization.

If you receive a commercial email or text message from us, you may unsubscribe at any time by following the instructions contained in the email or text message. You may also choose not to receive commercial emails or text messages from us or opt out of analysis by sending us your request by email at hello@iroboup.com.

(5) Personal information subject cancels account

If you log out of your RoboUP account, you will not be able to log in to RoboUP products or services or access any of your information. However, you can open a new account at any time. Please note that while any changes you make will be reflected in our active user database within a reasonable period, we may retain all information you submit for backup, archiving, fraud, and abuse prevention, and as authorized by applicable law. for analysis, to comply with legal obligations, or where we reasonably believe we have legitimate grounds to do so. In addition, if certain information has been provided to third parties as described in this policy, retention of that information will be subject to the policies of those third parties.

After canceling your account, we will stop providing products or services to you and delete your personal information according to your request, unless otherwise provided by laws and regulations.

(6) Personal information subject obtains a copy of personal information

You have the right to obtain a copy of your personal information and you can do this yourself by downloading it from your user center.

If it is technically feasible and the data interface is matched, we can also directly transfer a copy of your personal information to a third party designated by you at your request.

If you have an online account with us, you may need to log in to your account to authenticate. If you do not have an account with us, you may be required by law to provide additional information to verify your identity before we can act on such a request.

This additional information may vary depending on the nature of your request and/or the nature of the information your request relates to. In some cases, the law may also require us to obtain a signed statement from you, made under penalty of perjury, that you are the subject of the request. If we suspect fraudulent or malicious activity on your account, we will defer acting on your request until we can properly verify your identity and the authenticity of your request.

We will respond within 5 days.

In principle, we do not charge fees for your reasonable requests, but for repeated requests that exceed reasonable limits, we will charge a certain cost depending on the circumstances. For those that are gratuitously repetitive, require excessive technical means (for example, require the development of new systems or fundamentally change existing practices), pose risks to the legitimate rights and interests of others, or are very impractical (for example, involving information stored on backup tapes) request, we may deny it.


We will not be able to respond to your request under the following circumstances:

You may designate an authorized agent to make requests on your behalf consistent with applicable law. We accept designated documents in the form of a valid power of attorney and/or a notarized statement. It applies to the personal information of certain California residents who are consumers who receive products or services from us as a business, as those terms are defined under the California Consumer Privacy Act of 2018 (California Civil Code §§ 1798.100 to 1798.199) and its implementing regulations ("CCPA"), as amended, or superseded from time to time.

California Consumer Rights and Choices

If you are a consumer, California law may allow you to request information about:

• The categories of personal information (as defined under applicable California law) that we collect, sell, share or disclose;

• The purposes for which the categories of personal information we collect are used;

• The sources from which we collect the personal information;

• The categories of third parties to which we disclose personal information; and

• Certain personal information we collect about you.


Additionally, if you are a consumer, you can

• Opt out of the sale or sharing of your personal information for cross-context behavioral advertising purposes. We will not sell or share your personal information as these Terms are defined under California law;

• Opt-in to certain financial incentive programs we may offer in connection with the collection, sale, sharing or deletion of your personal information;

• Under certain circumstances, require us and our service providers to delete your personal information;

• Correct inaccurate personal information we hold about you; and

• Limit the use of sensitive personal information. Under California law, you may limit the use and disclosure of your sensitive personal information to certain purposes required by law. We only use or disclose sensitive personal information for such permitted purposes and therefore we do not offer an opt-out.


In addition, California law provides that consumers have the right not to be subject to discriminatory treatment and businesses may not exercise these rights with respect to personal information.

 

Collection, Disclosure, Sale, and Sharing of Personal Information

In the past twelve months since this Notice was last updated, we may have collected the following categories of information about you, directly or indirectly from you or our affiliates through your use of RoboUP products and services:

Identifying information, such as your name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name.

California categories of personal information. Citizenship Code Section 1798.80(e), such as your name, address, phone number, education, employment status, work history, bank account number, credit card number, debit card number, or any other financial information.

Sensitive personal information: account logins and precise geolocation data.

Characteristics of a protected class, to the extent provided by California or federal law, such as sex.

Business information, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming history or tendencies.

Internet or other electronic network activity information, such as browsing history, search history, and information about consumers’ interactions with internet sites, applications, or advertisements.

Geolocation data, such as precise physical location and approximate location.

Professional or employment-related information, such as job application or resume information, past and current employment history, and job performance information, unless exempt.

Sensory information such as audio, electronic, visual, thermal, or similar information. We collect this information directly from you, such as the products and services you purchase.

Inferences drawn from personal information, such as consumer profiles reflecting consumer preferences, characteristics, psychological trends, preferences, tendencies, behaviors, attitudes, intelligence, abilities, and aptitudes.


We collect the above information (1) directly from you, such as forms you fill out or products and services you purchase, (2) indirectly from you, such as by observing your behavior on our website or from your device, or (3) directly from our affiliates. We use this information for our business purposes, including:

(1) Reviews related to current interactions and concurrent transactions with consumers, including but not limited to counting ad impressions for unique visitors, verifying the targeting and quality of ad impressions, and reviewing compliance with this Code and other standards.

(2) Detect security incidents, prevent malicious, deceptive, fraudulent, or illegal activity, and prosecute those responsible for such activity.

(3) Debugging to identify and fix bugs that impair existing intended functionality.

(4) Short-term, transient use, provided that the personal information is not disclosed to other third parties or used to build consumer profiles or otherwise alter the individual consumer experience outside of the current interaction, including but not limited to as part of the same interaction Contextual customization of ads displayed.

(5) Perform services on behalf of businesses or service providers, including maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing services, providing analytic services, maps service and Lawn Mower Safety/Regulatory Notices, Find your lost RoboUP product. Unlock geofencing capabilities for designated areas, or provide similar services on behalf of a business or service provider.

(6) Conduct internal technology development and demonstration research.

(7) Conduct activities to verify or maintain the quality or safety of services or equipment owned, manufactured, manufactured for, or controlled by the enterprise, and to improve, upgrade, or enhance services or equipment owned, manufactured, manufactured for, or controlled by the enterprise, including keeping records related to your geofence unlocking decisions.

(8) If you apply for a position with RoboUP, we may use your information to recruit talent for us or our affiliates.

(9) Display your user profile.

We have not sold your personal information in the past twelve months since the date of our last review of this Privacy Policy, do not currently sell your personal information, and will not sell your personal information in the past twelve months since the date of our last review.

Please note that we do not accept or process requests through other means (such as via fax or social media).

We will review the information provided and may request additional information to ensure we are interacting with the correct individual. If you have an online account with us, you may need to log in to your account to authenticate. If you do not have an account with us, you may be required by law to provide additional information to verify your identity before we can act on such a request. This additional information may vary depending on the nature of your request and/or the nature of the information your request relates to. In some cases, the law may also require us to obtain a signed statement from you, made under penalty of perjury, that you are the subject of the request. If we suspect fraudulent or malicious activity on your account, we will defer taking action on your request until we can properly verify your identity and the authenticity of your request.

By law, we are not required to collect personal information that we would not collect in the ordinary course of business, retain personal information no longer than we would retain such information in the ordinary course of business, or be re-identified or otherwise linked to Information maintained as personal information. If we do not ask you to provide specific additional information to verify your request, please do not send such information.

We generally avoid asking you to provide additional information for verification purposes. However, if we cannot reasonably verify your identity or require more information for security or fraud prevention purposes, we may consider any of the following factors, individually or in combination, when requesting additional information:

• The type, sensitivity and value of personal information collected and maintained about consumers, as applicable law requires more stringent verification processes for sensitive or valuable personal information;

• The risk of harm to consumers from any unauthorized access or deletion;

• The possibility of fraudulent or malicious actors seeking personal information;

• Whether the personal information provided by consumers to verify their identity is sufficiently reliable to prevent fraudulent requests or being deceived or fabricated;

• The way businesses interact with consumers;

• Technologies available for verification;

• Other factors that may be reasonable under the circumstances, consistent with industry practice, recommended by California government officials, or that may be required by law or regulation after this Privacy Policy becomes effective.


If your request involves household information, you will need to follow the same verification steps described above before we can provide you with aggregated household information. For us to process a request to access or delete specific information about your family, all family members must make the request, and we must be able to verify each family member.

In some cases, we may not have enough information about you or your household to verify your identity or sufficiently distinguish you from other consumers or households to achieve the degree of certainty required by law, in which case, we will not be able to act on your request. In this case, we may not be able to identify you or your family members in the future without collecting a large amount of information.

Unable to obtain further information or seek re-identification or de-identification. We do not currently intend to take such steps to respond to requests made under this Privacy Policy, nor are we required to do so by applicable law. If in the future we determine a reasonable way to identify you or your household without such steps, we will provide you with an update through this Privacy Policy and respond to any such request at that time.

Information you submit for us to verify your identity to facilitate consumer-related or family-related requests in accordance with California law will be used solely by us and our service providers, if any, for that purpose and for no other purpose. Unless we are required by law to retain such information for record-keeping purposes, we will take steps to delete any new personal information collected for verification purposes as soon as possible after processing your request.

Please also note that making any such request does not ensure complete or comprehensive deletion or deletion of the personal information or content you may have posted, and there may be circumstances where the law does not require or permit us to honor your request, including: For example, complying with your request may infringe upon the rights and freedoms of other consumers.


We reserve the right to charge a reasonable fee or take other appropriate action in response to requests from consumers or families that are manifestly unfounded or excessive, particularly because of their repetitive nature.

You may designate an authorized agent to make requests on your behalf consistent with applicable law. We accept designated documents in the form of a valid power of attorney and/or a notarized statement. Do Not Track

RoboUP does not currently take steps to respond to browser "Do Not Track" signals because uniform standards for responding to such signals have not yet been developed.

De-identified information

To the extent we maintain or use de-identified information, we will continue to maintain and use de-identified information only in a de-identified manner and will make no attempt to re-identify that information.

Financial Incentive Notice

In connection with our education discount program, we provide financial incentives to consumers for the retained sale of the consumer's personal information based on a good-faith estimate of the value of the consumer's data, which forms the basis for providing such financial incentives. The financial incentives offered are price discounts on certain RoboUP products and services, depending on relationships with employer groups or educational institutions with which we partner. Categories of personal information related to financial incentives or price or service differences include your place of employment or educational institution. You can choose to provide an email address associated with your employer or educational institution, which will be manually verified.

The method we use to calculate the value of consumer data is our good faith calculation of the likelihood that RoboUP products and services will be sold to consumers at your place of employment or educational institution.
